Terms of service
The services on this website are provided by Associazione Culturale Cittadina Universitaria Aenigma (hereafter mentioned as “Aenigma”), owner of the Edizioni Nuove Catarsi trademark, of the website edizioninuovecatarsi.org and of the respective domain name. Relationship with users is subject to Italian Law 88/2009 and to the following terms and conditions of sale.
Copyright
All content on this website such as texts, images, logos, etc. is owned or licensed to Aenigma and is protected by the applicable law on national and international copyright.
Trademark
Edizioni Nuove Catarsi is an Aenigma registered trademark and can’t be used without the written consent from Aenigma.
License
Aenigma provides a limited and personal access to this website and does not allow any download or modification of this website (even if partial) without expressed written consent.
The license does not include any use of this website content for commercial purposes. The use of our product catalogues, descriptions and price lists is not permitted.
It is also not possible to use information on this website for the benefit of other retailers, neither to use data mining systems, robots or software allowing the download or the extraction of content from our pages.
It is not possible to include our pages in other frames in order to connect other trademarks to ours. The publication of the contents of this website is uniquely aimed at the sale of the products within the catalogue.
User Account
If a user browses this website he/she is the only person responsible for the safety of the access data to the reserved area (email and password) and takes responsibility for all his/her activity on his/her personal account.
Users must provide correct, complete and accurate data. They shall also immediately provide updates if any change occurs, and keep all their personal data safe. Users shall log in and update personal information from the website section My Account.
The service shall never and in no way be used to interrupt, damage or cause malfunctioning to this website, for illicit purposes and frauds or to affect or undermine this website activity.
Aenigma reserves the right to close an account at any moment, to delete orders or not to provide its services in case of the violation of applicable law, of Terms and Conditions or of applicable guidelines. It furthermore reserves the rights to prosecute any existing misuse of the service provided.
Product catalogue
Aenigma invests considerable resources in order to accurately update its catalogue; nonetheless considering the numerous products in the above-mentioned catalogue, some information about the products may not be correct.
For example, descriptions and images might not be accurate, complete, updated or correct. If you happen to buy a product that doesn’t correspond to the information on this website, it is possible to return it. Users are entitled to return products within 14 working days from delivery.
It may seldom happen that products indicated as available during the order procedure might not actually be available. In this case, the product will immediately be deleted from the User order and the User will be informed via email and will bear no cost.
If the user has already paid via Paypal, the cost of the product that is not available will be refunded without extra cost. If the user opted for a “cash on delivery” payment, the cost of the deleted products will be removed from the sum to be paid at delivery. In case the product that is not available is the only product within the order, the latter will be deleted. Orders containing other products that are available will be regularly delivered and cannot be deleted.
Wrong pricing might occur. In such cases, the price of the product shall be updated and our Customer Service shall inform the user to know if he/she wishes anyway to buy it or to cancel the order without extra cost.
Many products within the category “journals” show a different price on their cover if compared with the website. This is due to the fact that they are back issues, the valid price is the one you find on the website.
Delivery times indicated in the product details are approximate and not binding. Because of courier delays in deliveries, such delivery times might not always be respected.
Contract terms
Aenigma sells its products on its website online bookshop. Once they buy a product, Users become Purchasers.
In order to buy one or more products within the bookshop Users can select products and add them to the virtual shopping cart; once the product selection is completed Users shall close the cart and forward the order.
Before forwarding the order they shall receive a summary of all the products chosen and their prices. They shall choose which delivery they prefer, how they wish to pay and if they wish to receive an invoice.
Byclickingonthe“ORDER” buttonUserswillsendtheirpurchaserequesttoAenigma,that will manage it considering all the products selected in the cart. An automatic confirmation email (“Order confirmation”) will be notified to the User as soon as we receive your purchase request. Such confirmation does not entail a request acceptance by Aenigma. It is only a receipt confirmation after which relevant data are checked and the availability of the ordered products verified.
The sale contract with Aenigma is formed only once the purchase request is accepted and notified by email. The latter will also contain delivery information as well as delivery times (“Delivery”).
In case the order has to be completed in different deliveries, an email with all relevant delivery information shall be sent for each delivery.
Risk of loss
All products purchased on this website are subject to delivery contracts.
The risk of loss is borne by Aenigma in the case of a standard delivery within Italy by Poste Italiane (costs included).
If the delivery is organised differently and by a Courier chosen and paid by the User, the risk of loss is borne by the User after Aenigma delivers the parcel to the Courier.
Limitation of liability
This website uses technologies provided by the Wix.com platform.
Aenigma provides no express nor implied warranty on the efficiency of the website.
The access to the website may furthermore be occasionally or temporarily suspended to allow the necessary maintenance procedures or to update the website with new services or products.
While using the world wide web, including this website, users take all the possible risks connected to viruses or other potentially harmful components for computers. As a consequence, Aenigma can’t be held responsible for any kind of damage arising from the use of this website.
Aenigma reserves the possibility to cancel non-reliable orders. It also reserves the possibility, at its sole discretion, to ask the user to change the payment method chosen without a claim from his/her part.
In conclusion, Aenigma shall not be held responsible for any harm, loss, income loss, direct or indirect costs or any other damage that does not directly depend on a serious breach of the sale contract obligations.
Jurisdiction
The users of this website accept that any dispute on the application and/or interpretation of this contract shall be governed by the Italian law to the exclusive jurisdiction of the court of Pesaro Urbino.
Modifications to the website and to its terms of use
Aenigma reserves the right to modify this website and its terms of use in any moment.
If any part of the terms of use shall be adjudged to be invalid, the other provisions shall still apply.
